Restorative Justice between Aspiration and Reality

Abstract
In the second half of the 20th century, the concept of restorative justice is not enough known and practiced in the Romanian socio-legal space. The legislative framework and the logistics infrastructure needed to carry out restorative justice programs are precarious and last resort. Despite some projects initiated by the Ministry of Justice in 2003-2004, which resulted in some encouraging results, these were not continued and the accumulated experience remained untapped.
The paper aims at presenting some significant aspects of restorative justice, the current situation of this concept in Romanian practice and some advanced proposals by competent institutions in the field. Also, the paper aims at revealing some states of fact, mentalities and visions that the application of the concept of restorative justice in Romania has to deal with. Finally, the positions of the international forum to which Romania is a party (U.E. and O.N.U.) and the steps taken in this regard will be summarized.
