The Importance of Forensic Expertise in Assessing the Legal Situation of Juvenile Migrants

Abstract
The European Community has strict legislation on the situation where illegal, juvenile, unaccompanied and unaccompanied migrants may or may not be expelled. Thus, if they are confirmed that their age is under 18, their expulsion is not accepted and the state they have reached has the obligation to accept them, to provide accommodation, food and schooling. If their age is older than 18, they may be expelled to the state from which they crossed the border illegally. Considering that they have no documents that can specify their date of birth, forensic expertise is the only valid legal form that can show their chronological age, regardless of their apparent biological age. The method of evaluation of the persons subject to this type of expertise is based on the principles of forensic anthropology, and possibly specific psychological evaluations eventually can be associated. These examinations involve a complex expert activity carried out by evaluation committees.
