Paternity - Aspects with Implications in the Matter of Probation of Filiation

Abstract
The establishment of filiation with my father got the interest of the modern legislator, and hence the interesting legislative changes in the last 15 years, either under the regulation of the Family Code or under the New Civil Code. Starting from the complexity of the causes raised by the reality of some cases, we have proposed that in this article we analyze some theoretical and practical aspects related to the means of proof in the field of actions in the field of paternity, namely the action in denial, paternity promoted by the mother's husband or the child's biological father, the action in contesting the recognition of paternity. Is the biological defeated by the best interests of the child? We will answer this question by analyzing cases from the judicial practice.
