Abstract
In the present study we have examined the constitutive content of the crime, with emphasis on the objective side of the crime, without neglecting the subjective side either. We have highlighted with priority the actions through which the material element of the objective side is achieved, starting from the need to understand these fraudulent maneuvers. We have also examined the cause of impunity provided in the incrimination text, appreciating its importance in the current context. The paper also presents some solutions from the judicial practice with emphasis on those adopted after the entry into force of the new codes. The paper can be useful to academia and practitioners, being part of the content of a university course in criminal law to be published at a recognized publishing house in the country.
