Abstract
The approach of the theme of the EUROPEAN CERTIFICATE OF MOSTENITOR is aimed at familiarizing the knowledge of readers about the European certificate of inheritance. In the context of our scientific approach, we have sought to put in a clearer light the chosen article by exposing the elements of law in the field of succession at both national and European level. Here, in the context of globalisation and the dynamics of relations of private international law, namely those in succession matters, it is shaping up as absolutely necessary to develop a legislative framework at European level that can regulate a legal document with the value and competences of a certificate of heir.
The purpose of the certificate is that it can be used by heirs, the legatee with direct rights to the succession and by the executors of the wills or administrators of the estate who must prove in another Member State their status or exercise that right of heir or legatee and/or the duties of executor or administrator of the estate.
It may be used to prove the status and/or rights of each heir or, where appropriate, of each legatee referred to in the certificate and the respective shares of the inheritance; the assignment of a particular good or property forming part of the inheritance of the heir/heirs or, where appropriate, the legatee referred to in the certificate; the duties of the person referred to in the certificate as executor of the will or as administrator of the estate.
The results of this research can be used in scientific papers.
