Diluting the Classical Procedure in Favor of the Digital Procedure in Cases with Minors
Last modified: 2022-07-19
Abstract
In the current context, following the expansion of the COVID-19 pandemic, there is more and more frequent discussion about the need to develop a network that allows the creation of a suitable environment for achieving the digitization of the judicial system.
The pandemic has uncovered the gaps in the judiciary in the entire digitization process. Thus, an example would be the rule that courts may communicate documents using electronic signatures and which was often inapplicable, because many courts were not equipped with such signatures.
The lacunary legislative framework is a common problem that does not allow the development of a real possibility of creating and expanding viable digitization mechanisms that comply with the procedural guarantees imposed by national and European legislation.
Trying to stop it, we can say that technology helps modern devices by diluting the classical procedure in favor of the digital procedure and in terms of cases with minors.
In civil matters, we show that the digitization of justice in Romania has developed in an extremely slow manner compared to the need for freedom and evolution of humanity, but also to a certain convenience of people.
In the context of the digitalization of the company, we appreciate that it is normal for the legal profession to start with a change of transformation toward new opportunities.
